Apple also Files Case Against Motorola Xoom in Europe [Report]

In this recent week, There have been lots of reports that Apple has filed a case against Samsung Galaxy Tab 10.1 in Europe. And with this case Apple got successful, As a German court has granted a preliminary injunction blocking Samsung from selling the Galaxy Tab 10.1 tablets across all European Union nations, except for the Netherlands, leading barring sales of the Samsung Galaxy Tab 10.1 in Europe
And now once again Apple has also filed a case against Motorola's Xoom Tablet in Europe.




Apple isn't just going after the Samsung Galaxy Tab in Europe, it's also attacking the Motorola Xoom. Apple's lawsuit, which was filed in Germany and led to Tuesday's injunction barring sales of the Samsung Galaxy Tab 10.1 in Europe, makes reference to a separate complaint against the Motorola Xoom. Patent expert Florian Mueller, who told Computerworld on Tuesday that the mounting patent cases could cast a cloud over Android licensing, found the original lawsuit, filed in Dusseldorf, Germany, and pointed out the Motorola action. The reference in the suit says that Apple has also filed a complaint over the design of the Motorola Xoom, which runs the Android operating system. But it's unclear if Apple is seeking an injunction that would immediately prevent Motorola from importing the tablets into Europe.


Here's a passage from the Samsung complaint that mentions two other lawsuits Apple instigated against iPad competitors -- Motorola and a local German company named JAY-tech.




That passage says that Apple filed with the same court (district court of Düsseldorf) a complaint over the design of the Motorola Xoom, but it doesn't state whether that complaint included a request for a preliminary injunction. While it's not stated explicitly, I suppose that the complaint against Motorola also asks the court for an EU-wide injunction -- but perhaps just for a permanent injunction without a previous preliminary one.
